Before you read
ITS.REAL is an independent, free-access network. No account is required for public browsing. Access is free, but harmful, fraudulent or abusive conduct is not permitted.
The “Operator” is the individual or organization responsible for ITS.REAL. “Participant” or “you” means a person using a covered feature. “Network” includes the website, available files, local network services and applicable community features. Proposed features are not represented as already available.
FOUNDATION · TERMS & GOVERNANCE
01. Terms of Service
ITS.REAL ("AWAKE" or the "Network") is an independently operated local network and collection of digital services. These terms govern only covered features for which this Agreement has been presented and affirmatively accepted. Selecting the unchecked acceptance box and then I Agree & Continue communicates an intention to accept the version displayed. Merely seeing the Wi-Fi name, connecting to Wi-Fi, arriving on a web page or using a route that never presented these terms is not treated as proof of contractual assent.
The Operator may set objective rules governing access to features that the Operator actually controls and may suspend them for proportionate safety, legal and security reasons, subject to applicable law and reasonable accommodation. These terms do not regulate a person's private life outside AWAKE or transfer any police, judicial or governmental authority to the Operator.
02. Privacy Policy
The initial public library is designed for anonymous, account-free browsing, reading, searching and downloads. Connecting to Wi-Fi and requesting a web page necessarily involves some technical processing by network equipment. The categories, purposes, service providers, retention periods and risks must be stated accurately in the operational privacy disclosure on this page; the Operator must audit the deployed Wi-Fi, DHCP, DNS, Caddy, Node and Next.js configuration before publishing that disclosure as verified.
Accepting community rules is not consent to targeted marketing, sale of personal information, sensitive data collection, content interception or undisclosed third-party tracking. If additional processing needs consent under applicable law, the Operator will explain it separately, offer meaningful choices and obtain the appropriate consent before starting it.
03. Data Storage & Retention Policy
Information will be collected and retained only for disclosed, legitimate purposes including delivering a requested service, essential security, responding to reports, maintaining legally necessary evidence and complying with lawful requirements. Actual retention periods, deletion processes, any backups and the existence of technical logs must be accurately listed in the operational privacy disclosure; no fixed deletion period is promised until it is implemented and verified.
The signed agreement cookie expires no later than 180 days after issuance, but clearing a browser cookie does not necessarily delete independent network logs. Requests to access, correct or erase information will be handled as required by applicable law, taking account of security, others' rights and lawful evidence-preservation obligations. A preservation hold must be targeted and ended when no longer justified.
04. Acceptable Use Policy
You may use AWAKE for lawful reading, learning, communication and community exchange. You may not use it to threaten, defraud, exploit, harass, abuse, unlawfully surveil, distribute harmful code, violate others’ rights, or interfere with the infrastructure.
Violations can lead to removal of specific material, loss of an individual feature or disconnection where justified. Rules apply to behaviour and genuine risks, not whether the Operator agrees with a visitor’s opinions.
05. Network Security Policy
You must not attack, probe without authorization, bypass access restrictions, impersonate infrastructure, intercept traffic, flood services, distribute credentials or try to access devices and data that are not yours. Security testing requires the Operator’s prior explicit permission and defined scope.
The Operator may use proportionate technical safeguards, restrict suspicious activity, isolate abusive devices and investigate credible security incidents. This does not authorize unlimited inspection of private content.
06. Content & Copyright Policy
Books, games, software, videos, sites and user submissions can be subject to copyright, trademarks, licences and other rights. Availability through ITS.REAL does not establish public-domain status, permission to redistribute or a licence for onward commercial exploitation. The Operator is responsible for checking the basis on which materials under the Operator's control are distributed.
Contributors must have authority for materials they upload or share. A rights holder may use the published complaints contact to identify a work, location and alleged infringement. The Operator may promptly restrict access while reviewing claims. Where a Canadian statutory notice-and-notice or other copyright obligation actually applies to ITS.REAL's role, that procedure must be followed; these terms are not a substitute for it.
07. Community Conduct & Moderation Policy
Participate without threats, cruelty, targeted harassment, discriminatory abuse, coercion or coordinated intimidation. Heated disagreement, lawful criticism, humour and good-faith challenges to the Network or its Operator are not, by themselves, misconduct.
The Operator may moderate spaces they provide, set posting limits, require corrections, remove material that breaches published standards and act faster where immediate safety or system integrity warrants it.
08. Non-Monetary Exchange Policy
If Community Offers or other exchange tools launch, listings must clearly indicate whether an item is a gift, loan, swap, repair offer or request. No money, hidden fees, mandatory points, disguised currency, coercive obligations or off-platform payment demands may be imposed through the Network.
Users—not the Operator—are responsible for accurately describing ownership, condition, safety and their authority to transfer items. The Operator is not automatically a party to any transaction or the custodian of exchanged property.
09. User Accounts & Messaging Policy
Initial public browsing and downloads do not require an account. Optional accounts and messaging are planned possibilities, not current promises. If introduced, account holders must protect access details, avoid impersonation, respect recipient boundaries and report compromise promptly.
Private messages are not a guarantee of end-to-end encryption, absolute secrecy or permanent storage. Specific messaging security and retention features must be disclosed before that feature launches.
10. Website Hosting & Upload Policy
Future community website hosting and uploads, if offered, may be subject to review, quarantining, format restrictions, malware screening, file-size limits and removal for abuse. Submission does not create an entitlement to hosting, publication, uptime or backups.
An uploader remains responsible for rights, content, software behaviour and security of the files they submit. The Operator may decline or disable material presenting credible legal, security or safety risks.
11. Service Availability Policy
ITS.REAL is offered on an experimental, volunteer and no-charge basis. Equipment can fail, power can be interrupted, bandwidth is finite, and features may be discontinued, repaired, moved or unavailable without advance notice during emergencies.
The Operator does not promise internet access, cellular service, emergency communications, permanent hosting, a specific transfer speed, continuous availability or preservation of any item.
12. Liability & Disclaimer Policy
ITS.REAL is a free, experimental service provided on an "as is" and "as available" basis. Except for warranties or obligations that cannot lawfully be excluded, the Operator does not promise uninterrupted availability, data recovery, error-free software, reliable internet access, the accuracy of third-party content or suitability for a particular task. Visitors are responsible for assessing sources, inspecting downloads and making their own backups.
This allocation of risk does not displace a duty of reasonable care where the law imposes one, excuse fraud or deliberate wrongdoing, authorize unsafe premises or eliminate statutory privacy, consumer, human-rights or other non-waivable remedies. The specific CAD $100 limit in policy 82 is expressly confined to the ordinary digital service failures described there and is subject to those exceptions.
13. Third-Party Content Policy
Third-party authors, volunteers, uploaders, publishers, external links and community members speak for themselves. Hosting or linking content is not an endorsement, certification, guarantee of safety or verification of factual accuracy.
The Operator may correct labels, withdraw resources, decline recommendations or respond to credible complaints without adopting the creator’s views or accepting responsibility for independent conduct.
14. Age & Eligibility Policy
Public educational content is intended to remain available without an account or collection of age-verification documents. A child's access to free learning material is not, by itself, treated as a legally enforceable signature by a person with contractual capacity. The Operator must not rely on an underage person's click as proof that all contractual waivers or indemnities are enforceable.
If optional messaging, public posting, hosting or in-person exchanges launch, the Operator must publish feature-specific age and safety rules in advance, use proportionate safeguards and obtain guardian involvement where legally required. No claim is made that every user-supplied item is suitable for all ages.
15. Policy Changes & Enforcement
This document is versioned and dated. Material changes to rights, liabilities, eligibility or personal-information practices should be plainly identified and, when legally necessary, require renewed affirmative acceptance before they apply. Changes are not retroactive merely because a page was edited.
Enforcement should be proportionate, documented where practicable, and based on a reasonable assessment of available evidence. Serious threats, exploitation and urgent network attacks may justify immediate action.
16. Governing Law & Dispute Resolution
To the extent applicable, Ontario and Canadian law governs the provision of the Network. Any dispute may be brought before a court having lawful jurisdiction, with Ontario as the preferred forum only where such a choice is legally effective. Nothing in this clause defeats mandatory jurisdiction, statutory consumer rights, accessibility and human-rights remedies, privacy complaints or lawful reporting to regulators or police.
The parties may try a good-faith informal resolution, but doing so is optional and does not require a person to miss a statutory deadline. No mandatory arbitration, class-action waiver, punitive fixed charge or shortened limitation period is imposed by this Agreement.
PROTECTION OF PEOPLE · NON-HARM
17. Anti-Harm Policy
Do not use the Network to deliberately injure, endanger, exploit or unjustifiably undermine another person’s safety, dignity, privacy, property, autonomy or lawful participation. This includes organizing harm through other users or services.
Harm allegations must be evaluated using context, evidence and a reasonably foreseeable risk—not simply because someone feels offended by disagreement.
18. Anti-Bullying Policy
Targeted humiliation, mobbing, persistent ridicule, degrading campaigns and repeated intimidation are prohibited. The same rule protects visitors, volunteers, moderators and the Operator.
Criticism of ideas, projects, public claims or conduct remains permitted when it does not become a sustained campaign of personal abuse.
19. Anti-Harassment Policy
Do not pursue unwanted communications, stalk, repeatedly contact someone after a clear refusal, encourage others to harass them or evade blocks and moderation restrictions to reach them.
A single serious threat or coercive act may justify intervention without requiring repeated incidents.
20. Anti-Discrimination Policy
Discriminatory exclusion, harassment and abuse on a protected ground under applicable human-rights law are prohibited. The Operator's moderation criteria concern evidenced conduct, safety, lawful operation and reliable service, rather than protected characteristics, disagreement or legitimate criticism.
Where the Ontario Human Rights Code or another applicable requirement calls for accommodation, requests will be considered individually and accommodation provided to the legally required standard, including the applicable undue-hardship test. No provision here purports to waive an individual's human-rights protections.
21. Anti-Exploitation Policy
Do not take unfair advantage of children, older people, people facing disability, financial hardship, housing insecurity, social isolation or limited technical knowledge. Predatory tactics, engineered dependency and manipulative demands for resources are not welcome.
A user’s need for help is never consent to coercion, abuse, extraction of private information or unwanted personal relationships.
22. Anti-Coercion Policy
Blackmail, extortion, threats of disclosure, forced transactions, abusive ultimatums and pressuring someone to perform unwanted acts are prohibited. Agreement to use ITS.REAL cannot be used to compel anyone to surrender rights or possessions.
Consent for a community activity must remain voluntary and may be withdrawn prospectively, subject to fair and lawful consequences for obligations already performed.
23. Personal Boundaries Policy
Respect a person’s refusal to meet, communicate, exchange, disclose information or continue a conversation. Do not treat network membership as permission for physical visits, persistent messages or sexual advances.
Blocks, refusals and requests to stop contact must not be evaded using alternate accounts or intermediaries.
24. Child Protection Policy
Do not groom, sexually exploit, threaten, solicit sexual content from, or attempt to arrange harmful contact with a minor. Child sexual abuse material and instructions to facilitate abuse are prohibited and may be referred to appropriate authorities.
Future child-facing features require proportionate safeguards; the Operator does not promise constant active monitoring of every interaction.
25. Threats & Violence Policy
No credible threats, incitement of imminent violence, coordinated assaults, weaponized intimidation or attempts to locate another person for an attack. Safety concerns may prompt emergency suspension, preservation of relevant evidence where lawful, or contact with emergency services.
This policy does not prohibit non-threatening discussion of history, literature or legitimate safety education.
26. Self-Harm Encouragement Policy
Do not coerce, urge or manipulate another person into suicide, self-injury or dangerous behaviour. Threatening to injure yourself as leverage against a participant is also prohibited.
Good-faith discussion, education, mutual support and requests for help are not violations.
DIGNITY · PRIVACY · TRUTHFULNESS
27. Anti-Doxxing Policy
Do not publish or solicit non-public addresses, contact information, identity documents, location details or other identifying data to expose, intimidate, harass or endanger a person.
Information that is technically searchable elsewhere is not automatically appropriate to repost in a harmful context.
28. Impersonation Policy
Do not misrepresent yourself as another user, a moderator, the Operator, a public authority or a copyright owner. Satire and clearly identified fictional personas may be allowed where not used to deceive.
Misrepresenting administrative authority, official notices or emergencies is a serious violation.
29. Consent to Publication Policy
Do not disclose private conversations, photographs, recordings, confidential files or personal information without a lawful basis or appropriate consent. Consent to a conversation is not necessarily consent to public posting.
This rule does not bar lawful reporting of wrongdoing, required legal disclosure or the use of evidence to seek legitimate assistance.
30. Intimate Privacy Policy
Non-consensual intimate imagery, threats to release such material, sexual coercion and sexually invasive surveillance are prohibited. Altered or AI-generated intimate depictions used to humiliate, extort or violate a person’s privacy are also prohibited.
Possessing material privately does not grant a right to upload or redistribute it.
31. Reputation Protection Policy
Do not knowingly publish fabricated factual allegations, forged evidence or malicious false reports designed to damage another person’s reputation.
Honest opinions, substantiated criticism, warnings shared in good faith and lawful whistleblowing are protected from retaliation under these rules.
32. Anti-Manipulation Policy
Do not exploit deceptive interface design, fabricated urgency, fake endorsements, deceptive claims or pressure techniques to obtain consent, belongings, sensitive data or participation.
No one may represent an optional community contribution as mandatory payment for access to ITS.REAL.
FAIR PARTICIPATION · EXCHANGES
33. Good Faith Participation Policy
Represent offers, requests, availability, identity and intentions honestly. Do not deliberately waste other people’s time through repeated false requests, manufactured emergencies or knowingly impossible arrangements.
Mistakes, changes of mind before commitment and reasonable disagreements are not automatically bad faith.
34. No Predatory Behaviour Policy
No attempts to profit from desperation through exploitative conditions, forced labour, exploitative personal arrangements, predatory loans or demands for private access in exchange for essentials.
Assistance must not be conditioned on surrendering legal rights or submitting to humiliation.
35. No Retaliation Policy
Do not retaliate against someone for making a good-faith report, declining a proposal, ending contact, seeking legal advice, criticizing the Network or cooperating with an investigation.
Knowingly false complaints intended to punish someone are separately prohibited; an unproven good-faith complaint is not automatically false.
36. Anti-Fraud Policy
No scams, counterfeit offers, stolen-property listings, forged ownership proof, phishing or deliberately deceptive descriptions of resources. You must have authority to transfer what you offer.
The Operator may suspend suspicious listings, request reasonable clarification or report apparent crimes through lawful channels.
37. No Commercial Exploitation Policy
ITS.REAL’s public offering is intended to be free of access charges and advertisements. Do not insert sales pitches, payment gateways, paid memberships, hidden transaction fees or forced tips into community features without express written authorization and lawful disclosures.
External lawful commerce outside the Network is not controlled by this rule; the rule protects the non-monetary character of ITS.REAL’s own services.
38. Fair Exchange Policy
Describe item condition, defects, ownership, pickup expectations and whether an item is given, lent, borrowed, repaired or swapped. Do not misrepresent a dangerous, recalled or unusable item as safe.
A completed voluntary barter is intended to be final between participants, subject to applicable laws and remedies for fraud, misrepresentation, unsafe products, coercion or other legally recognized exceptions.
39. Community Safety Reporting Policy
Reports should identify the incident or material, describe the concern and provide relevant evidence while avoiding unnecessary sensitive information. Reporters must not manufacture evidence, threaten retaliation or use the process to harass people. The Operator may prioritize urgent child-safety, violence and security matters and reject clearly abusive or repetitive submissions.
Good-faith reporting to police, emergency responders, regulators or courts remains unrestricted. ITS.REAL is not an emergency dispatch service, and internal reporting does not guarantee confidentiality, investigative powers, an outcome or a response deadline. When practicable, affected people may request a review.
CYBERSECURITY · NETWORK INTEGRITY
40. No Malicious Software Policy
Do not distribute malware, ransomware, credential stealers, covert miners, destructive scripts, malicious macros or knowingly infected files. Educational security materials must not be used to attack the Network or others.
The Operator may quarantine uploads and block files or connections that pose a reasonable risk.
41. No Unauthorized Surveillance Policy
Do not intercept others’ traffic, capture private communications, run unauthorized packet sniffing, track users across devices or misuse access to cameras, microphones or connected systems.
The Operator’s own security functions remain subject to applicable privacy law and the published privacy disclosures.
42. No Network Abuse Policy
Do not flood bandwidth, exhaust storage, create denial-of-service conditions, run unauthorized scanners, host illegal activity, relay abusive traffic or use ITS.REAL as an attack platform.
Ordinary downloads and reasonable personal use are welcome; abusive technical conduct can be restricted to preserve service for others.
43. No Circumvention Policy
Do not bypass a revoked permission, ban, rate limit, content restriction or access-control measure through alternate devices, addresses, accounts or intermediaries.
Good-faith appeals and requests to restore access remain permitted through published contact channels.
ACCOUNTABILITY · ENFORCEMENT
44. Responsibility for Harm Policy
Participants are responsible for their own actions, statements, uploads, transactions, devices and decisions. Using ITS.REAL does not transfer their legal duties to the Operator or authorize them to harm others.
Responsibility does not imply that every alleged harm is proven; factual disputes are assessed on available evidence and applicable law.
45. Safety Enforcement Policy
Based on a reasonable and documented assessment of available information, the Operator may warn, remove specific material, restrict contact, rate-limit, quarantine devices, suspend a covered feature or terminate access. Serious credible threats, child exploitation, malware or imminent danger may justify immediate temporary action.
Enforcement must be proportionate, based on conduct and applied consistently without prohibited discrimination. Affected users may raise factual mistakes through the published contact channel where safe and practicable. Moderation grants no power to arrest, seize property, impose private fines, prohibit lawful reporting or punish conduct outside the service.
46. Protection Against Abuse of Authority Policy
Moderation authority must not be used for extortion, retaliation, discriminatory exclusion or personal gratification. Decisions should be based on safety, integrity, lawful operation and published rules rather than silencing ordinary criticism.
Where feasible, the Operator will provide a short reason and a way to request reconsideration, recognizing that urgent security cases may require limited disclosure.
ADDITIONAL PRIVACY · INFORMATION RIGHTS
47. Data Minimization Policy
Do not provide identity documents, medical details, addresses, financial details or other sensitive information unless a clearly described feature legitimately requires them. The Operator should collect the minimum needed for the disclosed purpose.
The present browser-facing agreement mechanism should require no name, email or profile to acknowledge rules.
48. Technical Metadata Transparency Policy
Wi-Fi and web systems inherently process technical routing information such as device network addresses, connection times and requested destinations. Depending on the deployed configuration, Wi-Fi access points, DHCP, DNS, Caddy, Node, Next.js and operating systems may also retain identifiers, access logs, error reports or monitoring history. Encryption in transit does not make every hostname or connection event invisible to the relevant network operator.
The live privacy disclosure must identify actual data categories, precise purposes, collection methods, any recipients or external processors, storage locations where relevant, retention/deletion schedules and meaningful residual risks. Unverified fields must be visibly marked as unverified and corrected before public launch; a general statement that data "may" be collected cannot replace a completed audit.
49. No Sale of Personal Data Policy
ITS.REAL is not designed as a data brokerage or advertising network. The Operator does not seek permission through this Agreement to sell user information or provide it to advertisers for targeting.
Any future materially different practice would require a separate, clear disclosure and a lawful basis; accepting these community rules is not advance permission.
50. Necessary Cookies & Local Storage Policy
After an affirmative acceptance, the server issues an essential HttpOnly, SameSite=Lax agreement cookie, protected by a server-only cryptographic signature, tied to the agreement version and content digest, and valid for no more than 180 days. It does not require a name, email address or account. The signed cookie establishes that this browser holds a server-issued acknowledgment, not that any particular human was identified or that all network access routes required acceptance.
This acknowledgment is not consent to analytics, advertising, optional monitoring or new service features. It can be withdrawn from this browser using I Do Not Agree, which clears the cookie; other browser copies, independently generated records and applicable legal obligations are not necessarily erased by that action.
51. Privacy Choices & Withdrawal Policy
Accepting the safety and access terms is not blanket consent to unrelated personal-data practices. Optional processing must be described separately and, when the law requires consent, must have a lawful, meaningful opt-in or other valid basis. Refusal of an unnecessary practice must not be disguised as refusal of the entire free library.
People may withdraw optional consent prospectively where applicable law permits, subject to any lawful limitations. Declining the Network Agreement stops a browser acknowledgment and may prevent access to features gated by it. It does not revoke consent already given to independent third parties or erase lawful historical records automatically.
52. Access, Correction & Deletion Requests Policy
Where applicable law provides access, accuracy, correction, withdrawal, complaint or deletion rights, requests can be made through the published privacy contact channel. The Operator will respond within applicable legal periods, authenticate requesters only to the extent reasonably necessary and explain any lawful refusal.
Records may be retained to the minimum extent permitted or required for legal duties, a reasonable security investigation, other persons' rights or a genuine legal preservation obligation. A privacy request does not require surrender of an identity document by default.
53. Security Incident Response Policy
The Operator may restrict or disconnect affected systems, preserve focused incident evidence, investigate a suspected security or personal-data breach and remediate confirmed weaknesses. Access to investigation records is limited to people with a legitimate need, and records are retained for appropriate periods.
Where applicable privacy law requires breach records, notifications to affected people or reporting to the Office of the Privacy Commissioner or another authority, the Operator will carry those duties out, including assessment of any real risk of significant harm when relevant. This agreement does not replace a breach-response plan or guarantee perfect security.
54. Data Access & Least Privilege Policy
People assisting with moderation or administration should receive only the access needed for their assigned role. Private information must not be browsed out of curiosity, used for gossip or handed to unauthorized persons.
Administrative access is a responsibility, not ownership of users’ data.
55. Private Communications Boundaries Policy
The Operator does not obtain unrestricted permission to read or intercept private communications from a general network agreement. Optional messaging is not currently promised; before launch, the service must disclose whether messages are encrypted, who can access content and metadata, how abuse reports are handled, and when records expire.
Any later access to content must have an applicable legal basis and be proportionate to the stated purpose. Voluntary disclosure of messages by a participant, valid legal process and narrowly justified emergency action may be treated differently, but no blanket waiver is created here.
56. Lawful Disclosure & Cooperation Policy
The Operator may comply with valid legal orders or make voluntary disclosures when lawfully permitted and reasonably necessary to address an imminent threat. Requests lacking legal authority may be challenged or narrowed where appropriate.
ITS.REAL does not promise to conceal unlawful conduct, and does not claim that every request for user data will automatically be granted.
57. Privacy Contact & Accuracy Policy
Before publication, the Operator must supply a real monitored contact channel for privacy requests, misuse reports, copyright notices and legal inquiries, identify the legally responsible operator where required, and maintain accurate disclosures of actual processing and third-party services.
If technical behaviour differs from the published notice, the Operator must investigate, correct the processing or update the notice promptly, and obtain new consent when applicable. An unverified or missing contact is a publication blocker, not a substitute for notice.
ADDITIONAL CONTENT · COMMUNITY RIGHTS
58. Notice & Takedown Policy
A complaint should identify the affected work, content or person, the specific URL or location, the alleged violation and a method of contact. The Operator may temporarily disable material to manage credible risk, ask for adequate detail, assess competing rights and restore content when warranted. No promise is made that every complaint can be adjudicated immediately.
Copyright notices will be handled under whichever Canadian legal process applies to ITS.REAL's actual activities and role, including any applicable statutory notice-and-notice and retention requirements; removal alone does not automatically satisfy those duties. Complaints made in bad faith may be declined, but good-faith legal complaints cannot be prohibited.
59. No Illegal Trade Policy
Do not offer stolen goods, contraband, prohibited weapons, illicit drugs, fraudulent documents or other goods or services whose transfer would violate applicable law. An exchange remains prohibited even if no money changes hands.
Do not use swaps or gifts as a disguised mechanism to facilitate illegal commerce or exploitation.
60. Health, Safety & Product Condition Policy
Participants must disclose known material defects, hazards, contamination and important operating restrictions for items they offer. Do not advertise unsafe goods as medically safe or suitable for children without an adequate basis.
The Operator does not inspect or certify every object; recipients should independently check condition and suitability before use.
61. Meeting & Pickup Safety Policy
Any in-person meetup, delivery, pickup or exchange is arranged solely between participants unless the Operator specifically and separately agrees to help. Never assume that listing an item grants permission to enter another person’s home or property.
Respect appointments, boundaries and lawful property rights. ITS.REAL does not provide security escorts, background checks, transport guarantees or emergency response.
62. No Duty to Complete an Exchange Policy
An offer or request is not automatically a binding promise. Participants may decline before committing to an exchange and should communicate changes honestly.
Once a lawful exchange is completed, its intended finality does not defeat legally required remedies for fraud, defective title, safety obligations or other non-waivable rights.
63. No Operator Custody or Agency Policy
Unless explicitly agreed in a separate written arrangement, the Operator does not take title to exchanged items, store goods on behalf of users, handle payments, act as their agent, arbitrate their contracts or warrant a participant’s identity.
ITS.REAL’s role is to provide communication tools, not become a party to every physical-world transaction.
64. Community Contributions & Licence Policy
Users keep ownership of original content they create. By submitting material for display, they grant the Operator a non-exclusive, revocable where legally applicable, royalty-free licence to host, cache, display, format and technically reproduce it solely to operate and moderate the submitted feature.
Contributors must have rights to grant that permission. The licence is not a transfer of copyright, blanket commercial exploitation right or permission to misrepresent authorship.
65. Corrections & Attribution Policy
Do not deliberately remove required copyright or author notices, fake attribution or mislabel sources to deceive readers. Reasonable corrections can be requested through the published contact channel.
The Operator may add disclaimers, remove duplicates or fix mistaken metadata without promising editorial review of every resource.
66. No Reliance on Educational Content Policy
Library, encyclopedia, how-to, health, financial, technical and legal materials are provided for learning and reference; they may be dated, mistaken or jurisdiction-specific. They are not individualized professional advice from the Operator.
Use independent judgement and obtain qualified assistance when a decision has serious safety, legal or financial consequences.
67. Accessibility & Respectful Design Policy
The Network should strive for readable, accessible interfaces and reasonable accommodation without conditioning access on unnecessary personal disclosures. Users must not weaponize accessibility tools or exploit another person’s disability.
The Operator’s capacity is limited, but applicable accessibility and human-rights requirements are not waived by the free nature of the service.
ADDITIONAL OPERATOR PROTECTIONS
68. No Guarantee of Accuracy Policy
Catalogues, metadata, search results, tags, translation, automated classifications and availability indicators may be incomplete or erroneous. The Operator may correct errors or withdraw mistaken entries.
An incorrect title, description, link or tag does not itself create a promise to provide a particular file or a guaranteed replacement.
69. No Guaranteed Downloads or Storage Policy
Download sizes, formats, compatibility, transfer reliability, resumability and available bandwidth may vary. An incomplete or corrupt download may need to be retried; users must verify their own files.
The Operator has no general obligation to store uploads forever, recover removed data or maintain a specific operating system, app or device compatibility.
70. Software & Device Safety Policy
Files and tools may interact differently across operating systems and hardware. Users are responsible for safeguarding devices, maintaining backups, using reasonable security protections and choosing whether to execute software.
To the maximum extent allowed by law, the Operator does not warrant that every downloadable binary, archive, emulator, script or game is harmless or fit for a particular device.
71. No Professional or Fiduciary Relationship Policy
Accessing ITS.REAL does not appoint the Operator as a lawyer, doctor, therapist, financial adviser, trustee, guardian, escrow holder or personal representative.
Community volunteers cannot create binding duties for the Operator merely by offering advice or personal help unless the Operator explicitly authorizes the arrangement.
72. No Partnership or Employment Policy
No network use, post, volunteer activity, referral or informal contribution by itself creates employment, partnership, agency, fiduciary duty, franchising or a joint venture with the Operator.
Specific volunteer roles or professional arrangements, if ever offered, should have separate written terms appropriate to their actual circumstances and the law.
73. No Obligation to Expand Policy
Ideas described as future services—including messaging, games, community offers, user hosting and resource tracking—are proposals, not binding commitments or promises of a release date.
The Operator may prioritize maintenance, shut down an unworkable feature or decline expansion without incurring a contractual obligation to build a particular service.
74. No Unauthorized Representation Policy
No visitor may claim to speak for ITS.REAL, solicit donations on its behalf, issue official statements, promise access, charge membership, create an affiliated service or sign an agreement for the Operator without express authorization.
References to ITS.REAL in fair commentary are not prohibited; misleading claims of official affiliation are.
75. Brand, Domain & Interface Protection Policy
The ITS.REAL name, logos, original interface, server code and presentation may be protected by applicable intellectual-property rights. Access does not grant a licence to clone the site in a deceptive way, spoof its domain or impersonate official notices.
Ordinary links, accurate descriptions, criticism, interoperability permitted by law and other lawful uses remain allowed.
76. Anti-Scraping Abuse Policy
Do not use automation that overloads infrastructure, circumvents reasonable rate limits, harvests other users’ information or unlawfully copies protected works.
This rule does not prohibit reasonable personal browsing, authorized accessibility technology or uses protected by applicable law. Large lawful datasets may be requested through published channels if available.
77. Resource Allocation & Fair Use Policy
Because ITS.REAL runs on finite donated or privately supplied infrastructure, the Operator may impose reasonable per-device speed, bandwidth, storage, connection and request limits to maintain availability.
Restrictions should serve network integrity and be applied consistently where practicable; no unlimited-capacity promise is made.
78. Emergency Shutdown Policy
The Operator may temporarily disable all or part of the Network when needed to address fire, electrical hazards, serious security failures, credible threats, equipment damage or legal orders.
Advance notice may not be possible; emergency action is not a guarantee that all damage can be prevented.
79. No Emergency-Service Reliance Policy
ITS.REAL is not a telephone carrier, emergency dispatch system or guaranteed route to the public internet. Do not rely on it to call emergency services, maintain health equipment, monitor a child or transmit urgent safety alerts.
In an emergency, use appropriate independent emergency communications instead of depending on network availability.
80. Third-Party Dealings & Disputes Policy
Participants are solely responsible for their own contracts, exchanges, meetings and relationships unless the Operator expressly becomes a party. The Operator may receive reports and moderate posts but is not required to mediate civil disputes.
Users may resolve claims directly or use lawful courts or agencies; ITS.REAL does not compel private arbitration or waive access to justice.
81. Limited Indemnity Policy
To the extent lawful, a participant who materially breaches the published rules by culpably uploading unlawful material, misrepresenting intellectual-property rights, deliberately damaging systems or committing other actionable misconduct agrees to indemnify the Operator for reasonable, proven third-party losses and reasonable defence costs directly caused by that participant's wrongful conduct, but only to the extent attributable to that participant and actually legally recoverable.
No indemnity applies to the Operator's own negligence, misconduct, unlawful acts or share of fault, and no participant owes an automatic fine or unrestricted reimbursement simply because someone alleges a claim. The Operator must act reasonably to mitigate loss, give prompt notice when practicable and avoid settlements imposing obligations on a participant without a lawful basis.
82. Limitation of Liability Policy
For claims arising only from ordinary failures of ITS.REAL's no-charge digital functions—such as temporary unavailability, interrupted downloads, lost convenience or non-critical software errors—and only to the fullest extent legally permitted, the Operator excludes liability for remote, unforeseeable or consequential economic loss. For direct, proven damages from those same ordinary service failures that a court finds contractually limitable, the aggregate contractual cap is CAD $100 per claimant for claims arising from the same event or related series of events.
This cap and exclusion do not apply to fraud, deliberate harm, or liability for personal injury, property damage, negligence, privacy violations, statutory rights or other remedies to the extent that they may not lawfully be excluded or limited. The cap does not decide who is legally responsible, cover claims by people who never accepted these terms, or limit remedies under mandatory law. It must be conspicuously disclosed before acceptance.
83. Duty to Mitigate & Backup Policy
Users should take reasonable steps to prevent avoidable losses, verify the suitability of exchanged items, retain their own copies of important information and stop using a feature presenting an apparent safety risk.
These expectations do not eliminate the Operator’s own mandatory legal duties or excuse proven wrongdoing.
84. No Collective Punishment Policy
When feasible, enforcement should target the responsible behaviour, account, content or device rather than punish unrelated community members. The Operator may still isolate a broader network segment where a technical threat cannot reasonably be contained otherwise.
A suspension does not authorize harassment or retaliation against the suspended person.
85. Appeals & Corrections Policy
A person affected by a non-emergency moderation decision may request review through the published contact channel, explain the error and provide relevant context. The Operator may decline repetitive or abusive submissions and is not required to operate a formal tribunal.
Where a significant error is established, the Operator should make a reasonable correction while preserving any lawful evidence needed.
86. Evidence Preservation Policy
Existing information relevant to a credible safety incident, legal claim, regulatory request or system attack may be placed on a targeted preservation hold where lawful and reasonably necessary. Preservation concerns identified records for a stated purpose; it does not authorize indiscriminate logging of everyone's activity or creating new surveillance without a lawful basis.
Access should be restricted, integrity protected, and the hold reviewed and lifted when no longer necessary. A preserved record is not automatically accurate, proof of identity or admissible evidence; the Operator must not alter or invent records.
87. No Waiver by Non-Enforcement Policy
If the Operator does not enforce a rule on one occasion, that does not automatically waive the rule for future cases. A deliberate, clearly communicated exception applies only to its stated scope, subject to law.
Discretion must still be exercised consistently with applicable human-rights, privacy and other legal obligations.
88. Severability Policy
If a court finds one provision invalid or unenforceable, the remaining provisions are intended to continue to the extent they can operate lawfully and fairly without it.
An unlawful clause does not become valid merely because this document says the rest survives.
89. Entire Agreement & Separate Terms Policy
For the covered features, this page states the community terms, privacy notice and risk disclosures in one place. A specific future service may require additional, separately presented terms and appropriately specific consent.
No hidden page, unseen third-party text or future policy becomes binding solely because of this general acceptance.
90. Interpretation & Plain Language Policy
Headings are for navigation. Examples clarify rules but do not create unlimited prohibitions. Ambiguities should be interpreted in light of safety, the Network’s non-monetary purpose and applicable law, not as permission for arbitrary punishment.
A visitor may save or print this Agreement and request reasonable clarification of material terms.
91. Notice of Material Changes Policy
Material changes must identify a new version and effective date and be shown prominently before they govern future covered use. Users who already accepted an older version will be asked to accept the new text before entering any features protected by the optional acceptance gate. The Operator will keep a copy of prior published versions so the terms in effect at a given time can be established.
Changes are not automatically retroactive and cannot waive existing legal remedies. Material new personal-data processing requires separate notice and the legally required consent or other lawful basis; simply updating a paragraph cannot supply consent by itself.
92. Good-Faith Complaints Against Operator Policy
Nothing prevents users from raising complaints about ITS.REAL or the Operator, publishing accurate criticism, asking regulators for assistance, contacting police, reporting security flaws responsibly or pursuing lawful remedies.
This protects the Operator too: transparent, fair boundaries are stronger than a purported ban on all criticism or legal action.
93. No Transfer of Legal Rights Policy
Accepting this Agreement does not transfer ownership of personal property, waive bodily autonomy, surrender statutory privacy rights, permit unlimited tracking or grant the Operator control over conduct outside the Network.
Any separate transfer, donation, exchange or grant of rights must be lawful, clearly explained and voluntarily authorized.
94. Contact, Identity & Publication Policy
Before public deployment, the Operator must provide and regularly monitor an accurate contact channel for complaints, security disclosures, legal requests, copyright issues and privacy requests, and provide the legal name or service address to the extent required by applicable law. A contact email is not necessarily a legally sufficient address for service of court documents.
The Operator must audit actual technical practices, rights to hosted content and the mechanisms by which acceptance is requested and verified. Publishing this document is not a guarantee of legal compliance, and later features such as messaging, hosting and physical exchanges require a renewed risk assessment before launch.
PRIVACY AT A GLANCE
What the browser acknowledgment does
The acceptance endpoint is designed to place an essential, versioned cookie in the browser. It does not create an account or store a named acceptance record. Network equipment and servers may process connection information and technical logs. The actual settings are listed below for verification; no advertising or optional tracking consent is requested here.

NETWORK DATA HANDLING
Operational privacy disclosure
When you choose I Agree & Continue, the server issues an essential signed, HttpOnly browser cookie containing the agreement version, a SHA-256 document digest and an issuance timestamp. Its maximum age is 180 days. No name, account or separate acceptance database is required by this package. The cookie is evidence of a server-issued browser acknowledgment, not proof of a particular human identity. Server/proxy logs, if enabled, are separately covered by the systems above.
